The impact of judicial recovery goes beyond the company covered by allowing, for example, the maintenance of jobs, the movement of the economy, the financial health of suppliers. It is a topic that brings together interests from the private, public and society sectors. Reality shows, however, that even with the law, a significant number of companies still cannot avoid bankruptcy. A USP survey carried out by sample reveals that 46% of large and medium-sized companies that enter into judicial recovery are unable to emerge from the crisis. Another survey , carried out by the PUC-SP Insolvency Observatory, based on requests for judicial recovery made between and in the state of São Paulo, shows that almost 60% of companies were unable to emerge from recovery after years of monitoring established by law.
Event “STJ's view on corporate issues and judicial recovery” With the aim of better understanding the process and thinking about ways to improve results, Trevisan and IREE organized an event with the Superior Court of Justice, which is the last decision-making instance on requests for judicial recovery. The event “Vision of the STJ on corporate issues and judicial recovery”, held on October, brought together seven STJ ministers Honduras Mobile Number List and distinguished debaters in presentations throughout an entire morning in São Paulo. “It is a great honor, in this moment of distress that Brazil is going through, to know what the court and its illustrious members think about judicial recovery and corporate law, how the court has acted to pacify relations to pave a safe path to the business environment in Brazil”, said the president of IREE, Walfrido Warde.
Warde warned that Brazil has treated its companies poorly by failing to differentiate the companies from their managers in the processes. “We have systematically vilified companies, expanding their responsibility without distinguishing companies from their directors, their administrators and their controllers. Our legislation has been conflicting with the protective jurisprudence of the Superior Court of Justice”, he stated. The meeting was supported by the Association of Federal Judges of Brazil (Ajufe), the São Paulo Association of Magistrates (Apamagis) and the OAB-SP. Coordinated by STJ minister Paulo Dias de Moura Ribeiro and the president of IREE, the meeting was opened by Antoninho Trevisan, president of the board of directors of Trevisan Escola de Negócios. Trevisan highlighted the importance of the role of jurists in stimulating economic development.
